In this article, Jason Rosell discusses developments in the availability of bankruptcy protection for cannabis operators. He concludes that subchapter V of Bankruptcy Code chapter 11, although streamlined, still does not alter the statutory framework for dismissal of a case. Congress needs to clarify that a company operating in compliance with state cannabis laws should be eligible for bankruptcy protection.
